Here are some of the FAQs that our expert lawyers get asked about making an investment fraud & mis-selling claim.

You might have been mis-sold or defrauded if:

  • You have lost a significant amount of money in an investment, even if you saw an initial profit.
  • You were persuaded to invest into high-risk and exotic investments such as overseas property, wine, commodities, cryptocurrency or unlisted shares, and have lost money or can’t access your investments.
  • You were talked into transferring a safe and secure final salary/defined benefit pensions (workplace pensions) into less suitable Self-Invested Personal Pensions (SIPPs), Qualifying Recognised Overseas Pension Schemes (QROPS) or other personal pensions.
  • You are a veteran and have been convinced into transferring out of the MoD pension scheme.
  • You were targeted by unscrupulous professional advisors because of your high-net-worth.
  • You were targeted by ungoverned salespeople, often via cold calls using hard -sell, pushy techniques. Often victims of this type of mis-selling are passed to regulated financial advisers to facilitate the inappropriate transfer. The motivation behind this is usually the generation of fees or commission for the advisers.
  • The negligence of your financial advisor has (or could have) made you worse off in life.
  • Your advisers failed to explain the risk, fees, charges, and details of any investments recommended.
  • You have lost money from your pension/investments or the benefits you thought you had have not materialised.
  • You have paid excessive fees and/or commissions (either as part of the transfer or on an on-going basis).
  • You were talked into unregulated and potentially fraudulent investments leaving you open to a high tax bill and the wrath of HMRC.
  • You have been advised to transfer perfectly good schemes into more expensive, complicated, and unsuitable products which you simply did not require.

You were advised to make investments that were not suitable for you. Some investments are more risk-averse than others, and a high-risk investment is not suitable for everyone. Professional advisors have a duty to match the product sold to the appetite for risk.

There are two key funds available to help victims of investment fraud & mis-selling:

Financial Services Compensation Scheme

If you were advised to invest and the provider or adviser (e.g. bank, building society, credit union, financial advisor, insurance company, investment company, pension scheme) has since gone out of business, you may have a claim with the Financial Services Compensation Scheme (FSCS). The FSCS exists to protect consumers when financial firms fail. If a UK-regulated adviser has given bad advice concerning an investment, and the provider or advisor has since gone out of business, the FSCS may be able to help.

Financial Ombudsman Service

If you were advised make an unsuitable investment and the firm/advisor has not gone out of business, you may be eligible for compensation via the Financial Ombudsman Service (FOS). When looking at your complaint, the FOS will examine at the specific circumstances of your case. As well as reviewing the information you provide, it will also consider the points put forward by the advisor/provider. Before pursuing a complaint with the (FOS), we will first give the financial business the opportunity to respond and put things right. If your complaint is upheld by the FOS, it will tell the advisor/provider what it needs to do. This could take the form of financial compensation.
